OOTB Solution’s procedures for paying agency represented talent ensure that everyone involved—hiring entity, agency, talent—remains compliant with current labor laws.
Agency represented talent are paid their contracted rate, less commissions due to their agency, through W-2 wages. OOTB will ensure timely payment of these wages in accordance with the Photo Shoot Pay Easement Act. The remaining agency and commission fees will be invoiced and paid directly to the relevant agencies.
Enacted in 2019, the California Photo Shoot Pay Easement Act allows employers to pay models, producers, photographers, and other employees on a print shoot in California on the next regular payday following the end of their work on a production. Previously, models and crew had to be paid on their last day worked.
OOTB Solutions communicates directly with each agency to collect booking terms and agency commissions due to the agency. All booking commissions are invoiced directly, along with agency fees billed to clients. This process allows talent to avoid paying taxes on wages due directly to the agency. It also means that agencies do not have to chase down fees or commissions.
